Register as a From My Mother’s Garden Stockist

You become a From My Mother’s Garden (FMMG) Wholesale Customer when you register a wholesale account with FMMG and FMMG approves your registration. By collating the information you provide, we aim to ensure that there is no conflict with any of our current stockists and check that our brand is compatible with the other brands sold in your store. On approval, we will send you an email with the information required to allow you to access trade prices on our website.  We ask that your first order consists of a minimum of 2 items per style and is a minimum value of £200+VAT or above.  If you prefer, you can place an order by emailing us on info@frommymothersgarden.co.uk. Please include your trading name and contact details. Orders placed are usually despatched within 2-3 working days subject to payment on a proforma basis. If an item(s) is out of stock, you will be notified of this and advised of the estimated timescale for delivery.

Trading Terms & Conditions

By placing your first order with us you are agreeing to our Trading Terms & Conditions therefore please read the information below carefully. “From My Mother’s Garden,” “FMMG”, “we”, “us” means From My Mother’s Garden “You” “Your” “Yours” means the Trade Customer to whom each sale relates “RRP” means Recommended Retail Price

Orders

After your first confirmed order, you can place repeat orders for any quantity or value subject to paying a shipping charge and proforma payment.

Cancellations

You have the right to cancel your Order within 5 days of placement. You must give and FMMG must receive written notification of cancellation of your Order by email to info@frommymothersgarden.co.uk. If you cancel your Order after this time period you must pay a cancellation fee which shall be 20% of the total Order value. FMMG has the right to cancel your Order or any part of it at any time, for example if we are unable to fulfil all or any part of your Order.

Delivery

Standard delivery charges apply on Orders up to £600.00. Delivery on Orders over £600.00 within the UK is free. Orders placed are usually despatched within 2-3 working days subject to payment on a proforma basis. If you choose to split your Orders, then standard shipping charges will be applied to each Order. If we have to put some items on back order as we are awaiting the stock, then we will cover the extra shipping cost. All orders will be shipped via overnight courier or Royal Mail.

Shortfalls

If, on receipt of your Order, there is a shortfall in goods ordered, you must notify FMMG within 3 days of delivery. If possible, we will send you replacements or a credit will be applied to your account. If FMMG is unable to supply any part or all of your Order, we will notify you and send replacements where possible or apply a credit to your account. Our total liability to you in any event shall not exceed the price paid by you for the relevant part of your Order.

Returns Policy

Our Returns Policy is as follows: Please inspect all garments and goods immediately upon receipt of your order. Any returns must be made within 7 days for a full credit or refund. Returns after that time will not qualify for a credit or refund except in exceptional circumstances. We cannot accept liability for items damaged whilst on your shop floor nor can we accept liability for items after they have been sold by you. You are advised to read our CARE LABELS and to ensure you and your staff are familiar with the advice when advising customers about how to care for FMMG products.  Please contact us if you would like to check the care instructions. Please email us on info@frommymothersgarden.co.uk if you wish to make a return within 7 days.  We will provide you with a Returns Number and discuss with you the best method of returning the item(s) to us. We will refund standard second class postage (not signed for) charges only unless we have expressly agreed with you a return by an alternative method. Please note: where non-fault returns are made without our express consent a re-stocking fee of 15% plus VAT of the value of the items returned will be (i) invoiced to you; or (ii) deducted from the value of any credit note(s) issued to you.

Legal Title

Title in any goods supplied by FMMG will remain with FMMG until payment in full has been received by us.

Copyright & Images

The words and images on the FMMG website, documentation, and publicity is owned by From My Mother’s Garden and subject to copyright. If you would like to use any of our images for promotional purposes please ask us first. You must not use any images or words without our prior written permission. Please email us and we can arrange for some images to be sent to you.  All intellectual property rights in connection with any of the Goods shall be owned by From My Mother’s Garden.

Website Only Retailers

We are currently only stocking Bricks & Mortar Stockists.

Online Trading & E-Commerce – All Customers

You may not sell on eBay, Amazon or similar website or any discount website without our express written permission.   Bricks and Mortar stockists with their own online trading/e-commerce platforms must adhere to any RRP that we set for any From My Mother’s Garden branded garments, gifts or accessories.

Bricks & Mortar Retailers – Moving Premises or Adding New Premises

Where your trading address changes or you are opening a new premises, and you wish to continue to sell FMMG you must contact us before you move to ensure we can still supply you at your new premises.  Please note we cannot guarantee that we will continue to trade with you if we have an existing customer in the area into which you will be moving. We operate a 5 mile exclusion radius.

Failure to Adhere to our Stockists’ Trading Terms & Conditions

We reserve the right to decline orders without notice where trade customers have breached our Terms & Conditions.

Limitation of Liability

From My Mother’s Garden shall not be liable for any damage or loss whatsoever and howsoever arising without our prior approval or consent.  Such approval or consent shall not be unreasonably withheld provided we are notified of any loss or damage within 7 days of the provision of those goods or services and we are given an opportunity to rectify or make good any faults or defects. From My Mother’s Garden shall not be liable or in breach of contract for the provision of goods or services – or any failure to provide those goods or services – if the damage or default whether wilful or neglectful arises out of the negligence, dishonesty or deliberate breach by or on behalf of individuals, agents or third parties beyond our reasonable control.  Similarly, where there has been a failure by you – or any party to whom you sell goods provided by us – to follow our reasonable instructions we will accept no liability for damage or wear and tear.

Force Majeure

From My Mother’s Garden shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause that is beyond our reasonable control.  Such causes include, but are not limited to: power failure, Internet Service Provider failure, industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action, including government mandated shutdowns or lockdowns in the event of a pandemic or similar risk to health event, or any other action that is beyond our control.

Privacy Policy

Any personal information that you provide to us including your name, address, telephone number and email address will be treated confidentially and will not be released, sold or rented to any entities or individuals outside of From My Mother’s Garden. We do however reserve the right to list your store’s contact details in listed stockists on our website or to provide these details to a potential customer upon request. We do not collect or record any credit card details you may provide when purchasing products from frommymothersgarden.co.uk.  Your credit card details are securely passed to and processed by our Payment Processor. Governing Law

The laws of England & Wales will apply in our contract with you and in all cases and without exception. These Terms & Conditions supplement the Terms & Conditions for use of our website.
